{"id":823,"date":"2013-01-11T01:06:58","date_gmt":"2013-01-11T06:06:58","guid":{"rendered":"https:\/\/www.artsbuildontario.ca\/pibi\/2013\/01\/11\/section-37-2\/"},"modified":"2017-04-21T14:43:17","modified_gmt":"2017-04-21T18:43:17","slug":"dev-incentives-2","status":"publish","type":"post","link":"https:\/\/www.artsbuildontario.ca\/pibi\/?p=823","title":{"rendered":"Development Incentives"},"content":{"rendered":"<h2>Section 37 is a way for municipalities and developers to help fund community projects<\/h2>\n<p>Increasingly, in Canadian cities with strong development activity, there is a way for developers to contribute to arts projects through what is called in Ontario \u2018Section 37\u2019.\u00a0 This refers to <b><span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.toronto.ca\/planning\/pdf\/s37_consolidation_080117.pdf\" target=\"_blank\">Section 37 of the Planning Act<\/a><\/span><\/b>, a \u2018density-for-benefit\u2019 agreement introduced by the province in 1983.<\/p>\n<p>In exchange for being allowed to build higher or with greater density than typically permitted, developers agree to include <b>community benefit amenities<\/b> in their projects, which can include parks, affordable housing, heritage preservation, or <b>arts facilities<\/b> (among others). In Toronto, ward councillors can negotiate <a href=\"https:\/\/mail-attachment.googleusercontent.com\/attachment\/u\/0\/?ui=2&amp;ik=4e30c91868&amp;view=att&amp;th=13e414bc460eda26&amp;attid=0.1&amp;disp=inline&amp;realattid=f_hfxy0bu50&amp;safe=1&amp;zw&amp;saduie=AG9B_P8NFvavch8J2jpBuRb53Ws6&amp;sadet=1366895291800&amp;sads=gQNxCPtLnEIcP6g6pW52FuVUMHg\" target=\"_blank\"><b>cash and in-kind benefits<\/b><\/a> from developers seeking adjustments to zoning regulations.<\/p>\n<h2>The approval process: how it works<\/h2>\n<p>Section 37 agreements are negotiated on a case-by-case basis.
